Can Kamala Harris shoot someone who breaks into her house?

“Harris tells Oprah any intruder to her home is ‘getting shot'” (Reuters):

Vice President Kamala Harris on Thursday issued a warning to any potential home intruder: “If somebody breaks in my house, they’re getting shot.”
The Democratic presidential candidate and gun owner made the seemingly unguarded comment in an interview with Oprah Winfrey before a live studio audience when the conversation turned to gun laws.
“I probably should not have said that. But my staff will deal with that later,” Harris said, laughing.

(The intruder doesn’t have to be a “threat to democracy” for gun violence to be justified? Also, if she owns a gun and is planning to use it in a crowded domestic situation, what kind of recurrent training does she receive? I’ve never heard of our future president going to the range. Dirty Harry used his gun regularly to shoot perpetrators, but he also was shown going to the range in at least one documentary film.)

I decided to post this question to a vast panel of gun owners… i.e., a friend who owns a vast panel of guns, (Maskachusetts is officially gun-free, at least when it comes to peasants owning serious firepower, but it turns out that there are exceptions…).

[Massachusetts] has a duty to retreat in general but in a house you have some more leeway I think. In any case I don’t talk like that. I would never presume to shoot someone in my house. 90% chance I can just hold them for the police.

For those who say that it is unrealistic that an intruder might get through Kamala Harris’s Secret Service protection, let me remind readers that a criminal mastermind managed to get a rifle, ladder, rangefinder, ammo, etc. past the Secret Service in Pennsylvania recently.

  1. In free states, property owners are generally able to use deadly force in self defense. If someone breaks into my home in Alabama, for example, if a reasonable person would fear the intruder, the shooting is probably justifiable under state law.

    In non-free states, of course, YMMV.

      My interpretation is that in a properly governed state, such as Maskachusetts, Kamala could not shoot an intruder (not without being charged with murder, in any case) if the intruder has broken in for the purpose of stealing her collection of Noam Chomsky memorabilia and doesn’t show any signs of wanting to attack her or another person.

    • philg, not really. What if Ms. Harris recalls that her collection of Noam Chomsky memorabilia has also rare first edition print of The Communist Manifesto autographed by L. I. Brezhnev and decides that she likes it to much and not to share it with the thief? If she does not let the thief to take it and then then thief gets physical, she still can shoot him.

    • I suspect the “reasonable belief that the intruder intended to inflict serious bodily injury” is easy to achieve.

      If the police show up and you have shot dead someone in your living room who is wearing a mask and carrying a backpack of your stuff, they’re more likely to high-five you than ask questions.

      And if that backpack contains Kamala’s well-worn Saul Alinsky first editions, all the better.

    The folks who want to take your guns will remain well-protected long after you aren’t. (Unless, apparently, you are Nancy Pelosi’s husband)

  3. Threat to succession would be the more realistic term. Meanwhile Kamalif just banned all plastic grocery bags, paid or not, making it impractical to go anywhere without driving.

  4. This reminds me of when Joe Biden said that he would shoot his shotgun into the air. Sounds reckless. At least he identified his gun. It is odd for Harris to say she has a gun, without saying what kind of gun it is.

    Most people think that you can shoot anyone in your home, but that is not really the law. You can shoot in self-defense. But she probably should not even be handling a gun, unless she has some practice and has thought carefully about when shooting is justified.

    • If she was talking tough, she should have shown us her gun, like Michael Dukakis showed us his tank!
